KILIMANJAROLAND TERMS AND CONDITIONS

These Terms and Conditions form part of your booking agreement with Kilimanjaroland. Please read them carefully before making a booking.

By making a booking, paying a deposit or other amount towards a booking, or participating in a Kilimanjaroland tour, challenge, event or other travel service, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

 

1. WHO WE ARE

Kilimanjaroland tours, adventures, challenges and events are operated by:

In these Terms and Conditions, “Kilimanjaroland”, “we”, “us”, “our” or “the Company” means Kilimanjaroland Mountain Events Limited.

“Client”, “traveller”, “participant”, “you” or “your” means the person making or participating in the booking, as applicable.

 

2. APPLICATION OF THESE TERMS

These Terms and Conditions apply when you:

  • Book directly through Kilimanjaroland;
  • Book through our website;
  • Book through email, telephone, WhatsApp or another authorised Kilimanjaroland communication channel;
  • Book through an authorised travel agent, sales representative, partner or marketplace;
  • Join a Kilimanjaroland fixed-date challenge or group departure;
  • Arrange a private Kilimanjaro climb, safari or other Kilimanjaroland travel service; or
  • Participate in an event operated by Kilimanjaroland.

Where a person makes a booking on behalf of another traveller or a group, that person confirms that they have authority to make the booking and accept these Terms and Conditions on behalf of the travellers concerned.

If a specific written booking agreement, itinerary or invoice contains terms expressly stated to override part of these Terms and Conditions, the specific written terms will apply to that extent.

 

3. OUR RESPONSIBILITIES

Kilimanjaroland will use reasonable skill and care when arranging and providing the travel services included in your confirmed booking.

We will take reasonable steps to:

  • Use appropriately trained personnel;
  • Obtain permits and approvals for services that we are responsible for arranging;
  • Select suitable accommodation, transportation and suppliers;
  • Follow applicable tourism, national park and other regulatory requirements;
  • Operate our activities with appropriate regard for safety;
  • Operate responsibly towards local communities and the environment; and
  • Provide the services described in your confirmed itinerary, subject to these Terms and Conditions.

Adventure travel involves factors that cannot be completely controlled.

We therefore do not guarantee specific outcomes, including:

  • Reaching the summit of Mount Kilimanjaro;
  • Completing a particular trekking route;
  • Seeing particular wildlife;
  • Particular weather conditions;
  • Uninterrupted access to a national park or attraction; or
  • That an itinerary will never require modification.

 

4. PERSONAL INFORMATION AND PRIVACY

To arrange your trip, we may need to collect and process personal information including, where necessary:

  • Full name;
  • Date of birth or age;
  • Sex;
  • Nationality;
  • Contact information;
  • Passport details;
  • Emergency contacts;
  • Dietary requirements;
  • Travel information;
  • Insurance information;
  • Medical information relevant to participation; and
  • Other information reasonably required to provide your booked services.

We will process personal information in accordance with applicable data-protection laws.

Information may be shared where reasonably necessary with organisations involved in delivering your trip, including:

  • Tanzania National Parks and other government authorities;
  • Immigration or regulatory authorities where legally required;
  • Hotels and lodges;
  • Transport providers;
  • Guides and operational personnel;
  • Emergency and medical providers;
  • Insurers where authorised or required;
  • Payment providers; and
  • Other suppliers involved in your booking.

We will not intentionally disclose your personal information to unrelated third parties for purposes unrelated to your booking except where you have consented or where disclosure is permitted or required by law.

Medical and other sensitive information will be handled with appropriate care and confidentiality.

Our separate Privacy Policy, where published, should be read together with these Terms and Conditions.

 

5. OFFICIAL COMMUNICATIONS

To reduce the risk of fraud or impersonation, clients should communicate with Kilimanjaroland only through our official communication channels.

These include:

  • Email addresses using the @kilimanjaroland.com domain;
  • Telephone and WhatsApp numbers published on our official website;
  • Official website enquiry and booking forms; and
  • Other communication channels expressly identified by Kilimanjaroland as official.

If someone claims to represent Kilimanjaroland and you are uncertain whether they are authorised, contact us through:

info@kilimanjaroland.com

Kilimanjaroland will not normally be responsible for money voluntarily sent to an unauthorised third party who is not acting on behalf of the Company, except to the extent that applicable law provides otherwise.

 

6. BOOKINGS

A booking request does not by itself guarantee a place.

Unless otherwise stated in writing, your booking becomes confirmed only when:

  1. Kilimanjaroland has accepted the booking;
  2. The required booking deposit has been received; and
  3. Kilimanjaroland has issued a booking confirmation.

Availability may change until the required deposit has been received.

You are responsible for carefully checking your booking confirmation, invoice, names, travel dates and itinerary and informing us promptly of any error.

 

7. BOOKING DEPOSIT

Unless a different amount is expressly stated for a particular tour, event or promotion, a 20% deposit of the total tour price per person is required to confirm your booking.

The booking deposit:

  • Forms part of the total tour price;
  • Is credited towards your final balance; and
  • Is subject to the cancellation and transfer provisions in these Terms and Conditions.

The deposit is not an additional fee on top of the advertised tour price.

 

8. FINAL PAYMENT

Unless otherwise agreed in writing, the full outstanding balance must be received by Kilimanjaroland no later than 60 days before the tour start date.

If a booking is made within 60 days of departure, full payment may be required at the time of booking.

Your booking should be fully paid before your tour begins unless Kilimanjaroland expressly agrees otherwise in writing.

Failure to pay an amount by its due date may result in cancellation of the booking.

Before cancelling for non-payment, we will normally make reasonable efforts to contact the person responsible for the booking.

If the booking is cancelled because of failure to pay, the cancellation charges in Section 13 will apply.

 

9. PAYMENT FEES AND CURRENCY

The client is responsible for ensuring that Kilimanjaroland receives the full amount shown as payable on the invoice.

Bank, payment-provider, international transfer or other transaction charges imposed in connection with a client's payment may be payable by the client where disclosed or applicable.

Any card-processing or payment-provider fee applicable to a payment will be disclosed through the relevant payment method or booking process.

Where a payment is received short because of bank or transfer charges, the outstanding amount will remain payable.

Where currency conversion is required, the exchange rate and charges applied by your bank, card issuer or payment provider are outside Kilimanjaroland's control.

 

10. PRICES

The price of your confirmed booking will normally remain unchanged.

However, after confirmation, an adjustment may be necessary where there is a new or increased:

  • Government tax;
  • National park fee;
  • Conservation fee;
  • Mandatory government levy;
  • Regulatory charge; or
  • Similar compulsory tourism-related charge imposed by an appropriate authority.

Where reasonably possible, Kilimanjaroland will provide evidence or an explanation of the compulsory increase.

Where a material mandatory price increase occurs before departure, you may, subject to applicable law and the circumstances of the increase:

  1. Accept the revised price and pay the difference; or
  2. Cancel the booking, in which case the applicable cancellation provisions will apply unless the law requires a different outcome.

Optional services added by the client after confirmation will be charged separately.

 

11. CHANGES REQUESTED BY THE CLIENT

Requests to change a confirmed booking must be submitted to Kilimanjaroland in writing.

We will make reasonable efforts to accommodate requested changes, but changes are subject to:

  • Availability;
  • National park rules;
  • Accommodation availability;
  • Transport availability;
  • Supplier conditions; and
  • Operational feasibility.

Any additional costs arising from a client-requested change must be paid by the client.

These may include changes in:

  • Accommodation rates;
  • Park or government fees;
  • Domestic flights;
  • Transportation;
  • Route arrangements;
  • Additional nights;
  • Private services; or
  • Other supplier costs.

If a requested change materially alters or cancels the original booking, the cancellation provisions may apply.

 

12. CHANGING YOUR TRAVEL DATE

Where a date-change request is received 90 days or more before the original tour start date, the booking deposit may be transferred once to another Kilimanjaroland tour or departure subject to the following conditions:

  • The new tour must commence within 12 months of the original tour start date;
  • The transfer must be for the same traveller;
  • The requested new departure must have availability;
  • Any increase in the price of the new tour must be paid by the client;
  • Any non-refundable costs already committed specifically for the original booking may remain payable where they cannot reasonably be recovered;
  • Only one transfer is permitted; and
  • Once transferred, the deposit remains non-refundable.

A transferred booking cannot subsequently be transferred to another person.

Requests made less than 90 days before the original tour start date are not guaranteed. Where we cannot accommodate the requested change, the standard cancellation charges will apply.

Where a supplier charges a reasonable amendment or rebooking fee, that cost may be passed on to the client.

 

13. CANCELLATION BY THE CLIENT

All cancellations must be submitted to Kilimanjaroland in writing by email.

The date on which Kilimanjaroland receives the written cancellation will be used to determine the applicable cancellation charge.

Cancellation charges are calculated per person as a percentage of the total tour price:

  • 90 days or more before the tour start date: 20% of the total tour price
  • 60–89 days before the tour start date: 30% of the total tour price
  • 30–59 days before the tour start date: 60% of the total tour price
  • 0–29 days before the tour start date: 100% of the total tour price — no refund

The 20% booking deposit forms part of the applicable cancellation charge and is not an additional charge.

For example, where a client has paid a 20% deposit and cancels 70 days before departure, the cancellation charge is 30% of the total tour price. The 20% already paid is credited towards the 30%; it is not charged again.

Where the amount already paid exceeds the applicable cancellation charge, the remaining eligible balance will be refunded, subject to permitted deductions described below.

Booking Deposit and Transfer Option

The booking deposit is generally non-refundable, subject to applicable law.

However, where a cancellation or date-change request is received 90 days or more before the original tour start date, the deposit may instead be transferred once to another Kilimanjaroland tour or departure under Section 12.

The transferred deposit:

  • Must be used by the same traveller;
  • Must be used for a tour commencing within 12 months of the original departure;
  • Cannot be redeemed for cash;
  • Cannot be transferred to another person;
  • May be used only once; and
  • Remains non-refundable following transfer.

 

14. REFUNDS AND TRANSACTION COSTS

Where a client is entitled to a refund, Kilimanjaroland will calculate the refund using the amounts actually received from that client and the applicable terms.

Where permitted by applicable law, non-refundable costs directly associated with receiving or returning a client's payment may be deducted.

These may include:

  • Bank fees;
  • Card-processing fees;
  • Payment-provider charges;
  • International transfer charges;
  • Currency-conversion costs; and
  • Other non-refundable transaction charges.

Kilimanjaroland will not deduct an amount that applicable law requires us to refund.

Refunds will normally be returned through the original payment method where reasonably practicable.

 

15. NO-SHOWS, LATE ARRIVALS AND EARLY DEPARTURE

No refund will normally be provided where a client:

  • Fails to arrive;
  • Arrives late and misses part of the trip;
  • Misses a scheduled service through circumstances personal to the client;
  • Voluntarily withdraws after the tour has started;
  • Chooses to descend or leave a trek early; or
  • Is unable to use an included service after the tour has commenced.

Unused accommodation, meals, guiding, park services, transport or other included services are generally non-refundable after the tour has commenced, except where applicable law requires otherwise.

If a client leaves the tour early, the client is responsible for additional expenses arising from the decision, including accommodation or transportation not included in the original itinerary.

 

16. CANCELLATION BY KILIMANJAROLAND

If Kilimanjaroland cancels your entire tour for operational reasons within our reasonable control, we will offer you either:

  1. A transfer to an equivalent or reasonably comparable alternative departure; or
  2. A 100% refund of the tour payments received by Kilimanjaroland for the cancelled tour.

Unless required by applicable law, Kilimanjaroland will not be responsible for independently booked or consequential expenses such as:

  • International flights;
  • Domestic flights purchased independently;
  • Visas;
  • Vaccinations;
  • Travel-insurance premiums;
  • Accommodation booked independently;
  • Independent transfers;
  • Personal equipment purchases; or
  • Other personal travel arrangements.

For this reason, clients should consider flexible or refundable travel arrangements and appropriate travel insurance.

Cancellation caused by circumstances beyond our reasonable control is governed by Section 17 rather than this section.

 

17. FORCE MAJEURE AND CIRCUMSTANCES BEYOND OUR CONTROL

Kilimanjaroland will not be considered to have cancelled or failed to perform a tour through fault of its own where the tour cannot reasonably operate, continue or be completed because of circumstances beyond our reasonable control.

These circumstances may include:

  • Natural disasters;
  • Earthquakes;
  • Floods;
  • Wildfires;
  • Extreme or dangerous weather;
  • Epidemics or pandemics;
  • War or threat of war;
  • Terrorism;
  • Civil unrest;
  • Political instability;
  • Government restrictions or official orders;
  • Border closures;
  • National park closures or restrictions;
  • Strikes;
  • Serious transportation disruption;
  • Major infrastructure failure; or
  • Comparable events outside our reasonable control.

Where such circumstances occur, Kilimanjaroland will make reasonable efforts, depending on the circumstances, to offer one or more of the following:

  • A modified itinerary;
  • An alternative departure;
  • Postponement;
  • A travel credit; or
  • A refund where appropriate or required by applicable law.

Where a refund is offered or required, unavoidable and non-recoverable costs already paid or irrevocably committed to third-party suppliers may be deducted only where and to the extent permitted by applicable law.

These may include non-recoverable amounts paid for:

  • Permits;
  • National park services;
  • Accommodation;
  • Transportation;
  • Domestic travel services; or
  • Other third-party arrangements specifically purchased for the booking.

Where deductions are made, Kilimanjaroland will provide a reasonable explanation upon request.

 

18. ITINERARY CHANGES BY KILIMANJAROLAND

Adventure travel requires flexibility.

Kilimanjaroland may make reasonable changes to an itinerary before or during a tour where necessary because of:

  • Weather;
  • Trail or road conditions;
  • Safety concerns;
  • Participant health;
  • National park requirements;
  • Government instructions;
  • Supplier changes;
  • Accommodation issues;
  • Transportation disruption; or
  • Other operational circumstances.

Where reasonably possible, we will provide services of a comparable nature or standard.

A reasonable itinerary alteration does not automatically constitute cancellation of the entire tour.

Safety decisions made during a Kilimanjaro trek may require modification of a route, schedule, campsite or summit attempt.

 

19. PASSPORTS, VISAS AND ENTRY REQUIREMENTS

Clients are responsible for ensuring that they meet all passport, visa, immigration, health and entry requirements applicable to their journey.

You should ensure that your passport:

  • Meets Tanzania's current entry requirements;
  • Has sufficient validity for your journey; and
  • Contains sufficient blank pages where required.

Visa, immigration, vaccination and entry requirements can change.

Information provided by Kilimanjaroland regarding such requirements is intended as general travel guidance and should not be treated as legal, medical or immigration advice.

Clients should verify current requirements with the relevant government authority, embassy, consulate, airline or qualified professional before travelling.

Clients are responsible for visa and entry-related costs.

If a client is unable to travel or is refused entry because they do not satisfy applicable passport, visa, immigration, vaccination or entry requirements, the standard cancellation terms will normally apply, subject to applicable law.

 

20. ACCOMMODATION

Hotels

Where the package specifies shared accommodation, the quoted price is based on twin or double occupancy.

Where applicable, a solo traveller may be paired with another traveller of the same sex.

A single room may be requested, subject to:

  • Availability; and
  • Payment of the applicable single supplement.

For private trips, accommodation arrangements will be based on the confirmed itinerary.

If a specified hotel becomes unavailable, Kilimanjaroland may arrange reasonably comparable alternative accommodation.

Kilimanjaro Tented Accommodation

Where tented accommodation is included, standard arrangements are generally based on two participants sharing a tent.

A single tent may be requested where operationally available and may attract an additional charge.

Accommodation arrangements remain subject to national park requirements and operational conditions.

 

21. PARTICIPATION OF MINORS

A person must be at least 18 years old to enter into a booking agreement with Kilimanjaroland.

A booking for a person under 18 must be made or authorised by a parent or legal guardian.

The adult making the booking accepts these Terms and Conditions on the minor's behalf to the extent permitted by law.

For Kilimanjaro climbs, Kilimanjaroland's standard minimum participation age is 10 years, subject to:

  • Applicable national park rules;
  • Kilimanjaroland's safety assessment;
  • The itinerary;
  • The minor's fitness and health; and
  • Any necessary parental, guardian or regulatory approvals.

Kilimanjaroland may apply a higher minimum age to particular routes, challenges or departures for safety or operational reasons.

Minors must be appropriately supervised by a responsible adult.

Kilimanjaroland does not provide childcare or general chaperoning services unless expressly agreed.

 

22. GROUP AND THIRD-PARTY OOKINGS

If you make a booking on behalf of other participants as a:

  • Group organiser;
  • Tour leader;
  • Travel agent;
  • Charity;
  • University representative;
  • Corporate representative;
  • Family representative; or
  • Other group coordinator,

you will normally act as the principal contact for the booking.

You are responsible for:

  • Providing these Terms and Conditions to each participant;
  • Ensuring participants receive relevant booking information;
  • Supplying accurate information about participants;
  • Communicating itinerary or booking changes;
  • Making payments where you have agreed to do so on behalf of the group; and
  • Obtaining appropriate authority from participants before supplying their personal information to Kilimanjaroland.

Individual participants remain responsible for complying with requirements that apply personally to them, including passports, visas, medical suitability, insurance and conduct.

 

23. FITNESS, HEALTH AND MEDICAL INFORMATION

Adventure activities, particularly high-altitude trekking, can be physically demanding.

Clients are responsible for considering whether they are sufficiently fit and healthy to participate.

Where appropriate, clients should obtain advice from a qualified medical professional before travelling.

Kilimanjaroland may require a participant to complete a health or medical declaration.

Where a disclosed medical condition may materially affect safe participation, Kilimanjaroland may reasonably request medical clearance from an appropriately qualified practitioner.

Clients must provide truthful and sufficiently complete information relevant to their safety.

Kilimanjaroland may refuse or discontinue a participant's participation where there are reasonable safety grounds, including where:

  • Material medical information has been deliberately withheld or falsified;
  • A participant's condition creates a serious risk to themselves;
  • A participant's condition creates a serious risk to others; or
  • A qualified guide reasonably concludes that continuation is unsafe.

Any refund arising from such circumstances will depend on the cause of withdrawal, recoverable costs, applicable cancellation provisions and applicable law.

A decision to descend a climber for safety or medical reasons is not a guarantee that evacuation or treatment will be cost-free.

 

24. DIETARY AND SPECIAL REQUIREMENTS

Clients should inform Kilimanjaroland of important dietary, mobility, medical or other special requirements as early as possible and preferably at least 30 days before departure.

We will make reasonable efforts to accommodate disclosed requirements.

Common dietary arrangements may include, where available:

  • Vegetarian;
  • Vegan;
  • Gluten-free; and
  • Halal meals.

Because some tours operate in remote locations, Kilimanjaroland cannot guarantee that every specialised requirement can be accommodated.

Clients with severe allergies or medical dietary requirements should inform us clearly before booking and obtain appropriate professional advice where necessary.

 

25. TRAVEL INSURANCE

Appropriate travel insurance is mandatory for participation in Kilimanjaroland adventure trips unless Kilimanjaroland expressly confirms otherwise in writing for a particular activity.

Clients should arrange comprehensive travel insurance as soon as possible after booking.

The policy should, where applicable, provide appropriate cover for:

  • Trip cancellation and interruption;
  • Medical emergencies;
  • Emergency medical treatment;
  • Emergency evacuation and rescue;
  • Repatriation;
  • Personal accident;
  • Lost, stolen or delayed baggage;
  • Flight delays or cancellations; and
  • Activities included in the booked itinerary.

For Kilimanjaro climbs, clients must ensure that their insurance is suitable for high-altitude trekking up to approximately 6,000 metres above sea level and provides appropriate emergency evacuation cover.

Where helicopter evacuation is important to the client, the client should verify specifically whether and under what circumstances their insurer provides such coverage. Helicopter evacuation cannot be guaranteed because availability depends on operational, weather, location and other circumstances.

It is the client's responsibility to:

  • Read the policy wording;
  • Confirm that the planned activities are covered;
  • Declare relevant medical information to the insurer;
  • Carry evidence of insurance where requested; and
  • Follow the insurer's claims procedures.

Where a client cancels because of illness, injury, flight disruption or another insured event, the client's rights against Kilimanjaroland continue to be governed by these Terms and Conditions.

The client may separately be entitled to claim losses from their insurer.

Where reasonably possible, Kilimanjaroland will provide legitimate supporting documentation such as:

  • Booking confirmations;
  • Invoices;
  • Receipts; and
  • Cancellation confirmations.

Kilimanjaroland does not guarantee that an insurer will accept or pay a claim.

 

26. VACCINATIONS AND HEALTH REQUIREMENTS

Health and vaccination requirements can change.

Any information provided by Kilimanjaroland regarding vaccinations, immunisations, malaria prevention or other health matters is general travel information and is not medical advice.

Clients should obtain advice from an appropriately qualified healthcare professional regarding their individual circumstances and current requirements for travel to Tanzania.

 

27. AUTHORITY OF GUIDES AND SAFETY INSTRUCTIONS

Clients must comply with reasonable safety instructions provided by Kilimanjaroland guides and operational staff.

During a Kilimanjaro climb, the lead guide has authority to make operational and safety decisions relating to:

  • The trekking programme;
  • Pace;
  • Campsites;
  • Route conditions;
  • Summit attempts;
  • Team management;
  • Weather-related decisions;
  • Emergency procedures; and
  • A participant's continuation or descent.

Where a guide reasonably considers that a participant's physical condition, behaviour or actions present a significant safety risk, the guide may require the participant to:

  • Stop;
  • Descend;
  • Modify the itinerary; or
  • Leave the activity.

Safety decisions must be respected.

 

28. INHERENT RISKS OF ADVENTURE TRAVEL

Adventure travel involves inherent risks that cannot be completely eliminated.

Depending on the activity, these may include risks associated with:

  • High altitude;
  • Altitude sickness;
  • Physical exertion;
  • Uneven terrain;
  • Slips and falls;
  • Extreme or rapidly changing weather;
  • Wildlife;
  • Remote locations;
  • Road travel;
  • Camping;
  • Limited medical facilities; and
  • Delayed access to emergency services.

By participating, you acknowledge that you have chosen an adventure activity that may involve risks greater than ordinary travel.

You agree to follow reasonable safety instructions and take reasonable responsibility for your own conduct and preparation.

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

 

29. LIMITATION OF LIABILITY

Kilimanjaroland will exercise reasonable skill and care in providing services for which it is legally responsible.

To the extent permitted by applicable law, Kilimanjaroland will not be responsible for loss, damage, delay, injury or expense resulting solely from:

  • The client's own acts or omissions;
  • An unrelated third party over whom Kilimanjaroland has no reasonable control;
  • Inherent risks of an adventure activity that have not resulted from Kilimanjaroland's actionable failure;
  • Force majeure;
  • Independent flight disruptions;
  • Government actions;
  • Border or park closures; or
  • Other circumstances that could not reasonably have been avoided.

Nothing in these Terms and Conditions is intended to exclude or limit Kilimanjaroland's liability where such exclusion or limitation would be unlawful.

 

30. THIRD-PARTY SUPPLIERS AND SUBCONTRACTORS

Kilimanjaroland may use suitably selected third-party suppliers and subcontractors to provide parts of a tour.

These may include:

  • Hotels;
  • Lodges;
  • Transport companies;
  • Airlines;
  • Independent guides;
  • Equipment suppliers;
  • Camps;
  • Activity providers; and
  • Other tourism service providers.

Some suppliers operate under their own terms and conditions and applicable laws or regulations.

Kilimanjaroland will use reasonable care when selecting suppliers for services included in our package.

Nothing in these Terms automatically removes any responsibility Kilimanjaroland may have under applicable law for services that form part of the package we have contracted to provide.

Kilimanjaroland is not responsible for services independently purchased by a client directly from an unrelated third party.

 

31. CLIENT CONDUCT

Clients must behave reasonably and must not engage in conduct that:

  • Endangers another person;
  • Seriously disrupts the experience of other participants;
  • Threatens or abuses guides, staff or other travellers;
  • Deliberately damages property;
  • Violates applicable law;
  • Violates national park rules; or
  • Makes continued participation unsafe.

Where serious misconduct occurs, Kilimanjaroland may require a client to leave the tour.

Where removal results from the client's misconduct, the client may be responsible for additional accommodation, transportation or other costs and may not be entitled to a refund for unused services, subject to applicable law.

 

32. DAMAGE TO PROPERTY

Clients may be required to pay reasonable costs for property they intentionally or negligently damage.

This may include:

  • Camping equipment;
  • Tents;
  • Vehicles;
  • Rented equipment;
  • Accommodation property; or
  • Other equipment belonging to Kilimanjaroland or its suppliers.

The client will not be responsible for ordinary wear and tear.

 

33. EQUIPMENT AND PERSONAL GEAR

Group camping equipment included in a Kilimanjaro package will be specified in the relevant itinerary or inclusions.

Clients remain responsible for obtaining and bringing appropriate personal clothing and equipment required for their trip unless expressly included.

Where rental equipment is supplied by an independent third party, that rental may be subject to separate terms.

Clients should inspect rental equipment and report significant problems promptly.

Clients are responsible for loss or damage caused to rental equipment in accordance with the applicable rental terms.

 

34. LUGGAGE AND VALUABLES

Clients are responsible for taking reasonable care of their baggage, money, electronic devices, jewellery, travel documents and other personal possessions.

Kilimanjaroland is not responsible for baggage lost, delayed or damaged by an airline or independent transportation provider except where responsibility arises under applicable law.

Clients should not place passports, money, valuable electronics or other essential valuables in checked luggage where avoidable.

Where luggage arrives after the client, any special delivery arrangements may incur additional costs unless included in the booking or covered by the responsible transportation provider.

Clients should consider appropriate baggage insurance.

 

35. INCIDENTAL EXPENSES

Clients should carry or have access to sufficient funds for personal and incidental expenses not included in their package.

These may include:

  • Tips;
  • Souvenirs;
  • Drinks;
  • Personal meals;
  • Optional activities;
  • Equipment rental;
  • Laundry;
  • Additional accommodation;
  • Personal transportation; and
  • Other personal expenses.

The specific inclusions and exclusions in the confirmed itinerary determine which services Kilimanjaroland has agreed to provide.

 

36. PHOTOGRAPHY, VIDEO AND MARKETING

During tours and events, photographs or videos may be taken by Kilimanjaroland staff, contractors, media personnel or other participants.

Kilimanjaroland will endeavour to respect reasonable requests from clients who do not wish their identifiable image to be deliberately used in Kilimanjaroland marketing.

Where Kilimanjaroland intends to use identifiable client imagery for promotional or commercial purposes, such use will be handled in accordance with applicable privacy and data-protection requirements.

Clients who do not wish to appear in promotional material should notify Kilimanjaroland in writing before the activity and remind the relevant trip leader at the start of the tour.

This clause does not control photographs or videos independently taken and published by other travellers or unrelated third parties.

 

37. INTELLECTUAL PROPERTY

Unless otherwise stated, content created and owned by Kilimanjaroland, including website copy, logos, branding, itineraries, graphics, photographs and marketing materials, may be protected by applicable intellectual-property laws.

No licence to commercially reproduce Kilimanjaroland branding or proprietary materials is granted merely because a client has booked a tour.

 

38. COMPLAINTS

If you experience a problem during your trip, you should notify your guide, trip leader or Kilimanjaroland representative as soon as reasonably possible so that we have an opportunity to address the issue.

If the matter is not resolved during the trip, a written complaint should be submitted to:

info@kilimanjaroland.com

Please provide sufficient details for us to investigate the matter, including where relevant:

  • Booking name;
  • Booking reference;
  • Travel dates;
  • Description of the issue; and
  • Relevant supporting information.

Kilimanjaroland will make reasonable efforts to review and respond to legitimate complaints.

Nothing in this complaints procedure removes rights available to a client under applicable law.

 

39. SEVERABILITY

If any provision of these Terms and Conditions is found by a competent authority or court to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remaining provisions will continue to apply to the extent permitted by law.

 

40. NO WAIVER

If Kilimanjaroland does not immediately exercise a right under these Terms and Conditions, this does not necessarily mean that the right has been waived.

A waiver relating to one circumstance does not automatically constitute a waiver in another circumstance.

 

41. CHANGES TO THESE TERMS AND CONDITIONS

Kilimanjaroland may update these Terms and Conditions from time to time.

The Terms and Conditions applicable to a confirmed booking will normally be those accepted in connection with that booking, except where:

  • A change is required by law;
  • A regulatory requirement must be implemented;
  • The change benefits the client; or
  • The parties agree otherwise.

The most recent version may be published on our website.

 

42. APPLICABLE LAW

These Terms and Conditions and the relationship between Kilimanjaroland and the client are governed by the laws of the United Republic of Tanzania.

The parties should first make reasonable efforts to resolve any dispute directly and in good faith.

Where a dispute cannot be resolved and no mandatory law provides otherwise, the matter may be submitted to the competent courts or other legally authorised dispute-resolution bodies in Tanzania.

Nothing in these Terms and Conditions excludes or limits any mandatory rights, protections or remedies available to a client under applicable law.

 

43. ACCEPTANCE OF THESE TERMS

By completing a booking, paying a booking deposit or other tour payment, or otherwise expressly accepting these Terms and Conditions, you confirm that you:

  • Have read these Terms and Conditions;
  • Understand the booking and cancellation rules;
  • Understand that adventure travel involves inherent risks;
  • Understand your responsibilities concerning travel documents, health and insurance;
  • Agree to pay amounts properly due under your booking; and
  • Agree to be bound by these Terms and Conditions, subject always to applicable law.
